Division of Assets: Medicaid Planning for Married Couples

June 16, 2014 by Sinclair Prosser Gasior

Division of Assets is the name commonly used for the Spousal Impoverishment Provisions of the Medicare Catastrophic Act of 1988.  It applies only to couples.  The intent of the law was to change the eligibility requirements for Medicaid where one spouse needs nursing home care while the other spouse remains in the community.  The law, in effect, recognizes that it makes little sense to impoverish … [Read more...] about Division of Assets: Medicaid Planning for Married Couples

Helping Your Parents Through Their Twilight Years

April 17, 2014 by Sinclair Prosser Gasior

Your parents were watching over you, smiling and encouraging, as you took your first tentative steps. As a teenager, they handed you the keys as you took the car out on your own for the first time. They were there with guidance and advice, sometimes requested and sometimes not, as you left childhood and navigated young adulthood. Trustee, Executor, Power of Attorney: Who You Choose Can Make a Difference

April 11, 2014 by Sinclair Prosser Gasior

When you create an estate plan, you choose people to make decisions for you, such as agents, guardians, executors, or trustees. Often, people do not give much thought to those decisions, just naming their oldest child or whoever pops into their mind. The choices for these roles are perhaps the most important decisions to make. Good choices can help to ensure your wishes are carried out while bad … [Read more...] about Trustee, Executor, Power of Attorney: Who You Choose Can Make a Difference

Medicaid Planning and Your Home

April 8, 2014 by Sinclair Prosser Gasior

When meeting with clients, I often get asked “If I go into a nursing home, will I lose my house?”  The answer is complicated, but if the state’s medical assistance program, … [Read more...] about Medicaid Planning and Your Home

The Importance of the Power of Attorney

February 7, 2014 by Sinclair Prosser Gasior

We initiated estate planning following a presentation by Sinclair Prosser Attorney Jon Gasior. We were so impressed, we contracted with them to complete our estate planning. Subsequently, we assembled information on our assets and Sinclair Prosser Gasior did the rest. Correspondence was communicated to our financial institutions and the estate was established. We were very pleased with the courteous manner of the Sinclair Prosser Gasior staff. However, it was their professionalism that made us satisfied we chose this firm to handle our estate. We have nothing but praise for Sinclair Prosser Gasior .
