After creating their estate plan, some clients are eager to discuss it with their decision makers, while others are reluctant to start the conversation. Both responses are understandable, but there are some discussions that you should make an effort to have with your decision makers. So how do you facilitate that?
- First, understand who your decision makers are. These are the people who would step into your shoes if you were to become incapacitated or pass away. They are your successor trustees, executors, financial power of attorney agents, and/or health care power of attorney agents. Once you understand who you need to share this information with, what should you discuss?
- First, you need to discuss where your decision makers can find your estate planning documents if something happens to you. Do you have a safe you plan to keep the documents in? Is there a combination that your Trustee will need to know to access your documents?
- Next, health care documents. Your health care documents include your Health Care Power of Attorney naming your agent who will step in if you become incapacitated; your Living Will explaining what type of care you would like in certain scenarios; and your HIPAA Release so whoever you have named as your agent can get the information they need.
- Next, in line with giving copies of your health care documents to your agents, it is important for you to understand that your documents can be a good prompt for important conversations with your family members regarding what types of care you would want in certain scenarios.
