 Why Do Heirs Prefer Trusts?

August 26, 2025 by Alexander M. Pagnotta, Estate Planning Attorney

Many individuals desire to have an efficient administration of their possessions and assets when they pass away. We all know there may be complexities in handling an estate after death, but most families want privacy and peace. Creating a trust will help provide your heirs or beneficiaries their inheritance in an effective manner. Trusts provide important protection for you and your loved ones during the course of your lifetime and after death. However, it is important that you select the right type of trust and go through the proper formalities, so it is legally valid and provides the protections that you expect. Sinclair Prosser Gasior can develop a plan that fits your needs and help plan for your beneficiaries to receive assets through the trust administration.

Heirs or beneficiaries can typically benefit from receiving their assets through the trust administration process, rather than the probate process, for some of the following reasons:

  • The trust administration process may be quicker.
  • The trust administration process can be much more private.
  • The trustee may have discretion.
  • The trust administration process does not involve going to court.

There may also be other reasons why your loved ones would prefer to inherit through a trust rather than going through probate. Sinclair Prosser Gasior will work with you to determine if a trust is right for you, in order to provide benefits and protections to heirs or beneficiaries and assist with the estate administration to carry out your wishes.

Testimonials

5 Stars

We initiated estate planning following a presentation by Sinclair Prosser Attorney Jon Gasior. We were so impressed, we contracted with them to complete our estate planning. Subsequently, we assembled information on our assets and Sinclair Prosser Gasior did the rest. Correspondence was communicated to our financial institutions and the estate was established. We were very pleased with the courteous manner of the Sinclair Prosser Gasior staff. However, it was their professionalism that made us satisfied we chose this firm to handle our estate. We have nothing but praise for Sinclair Prosser Gasior .
