Plan for Life: Proper Estate Planning Covers More Than Death

Comprehensive estate planning goes beyond wills and trusts. One of the most essential—but often overlooked—tools in any estate plan is the Power of Attorney (POA). These documents serve a vital role in protecting your interests during your lifetime, particularly in the event of illness, injury, or incapacity. In fact, we recommend at least this basic form of estate planning for anyone who has reached the age of eighteen (18).

What Is a Power of Attorney?

A Power of Attorney is a legal document that allows you (principal) to designate another person (agent or attorney-in-fact) to act on your behalf. POAs are versatile tools that can be tailored to address both financial and healthcare matters, depending on your unique needs.

There are several types of POAs we commonly prepare for our clients:

– Maryland Statutory Form Power of Attorney:** Incorporates changes to Maryland POAs in effect since October 1, 2023.

– Supplemental Durable Property (Financial) Power of Attorney:** Authorizes an agent to manage banking, real estate, and investment matters.

– Durable Power of Attorney for Healthcare (Medical POA):** Allows an agent to make medical decisions when the principal is unable to do so.

– Limited or Special Power of Attorney:** Grants authority for a specific task or time period.

Why Powers of Attorney Matter in Estate Planning

Estate planning is not just about distributing assets after death—it’s also about protecting your autonomy and ensuring your affairs are properly managed while you are alive (i.e. temporary incapacity). Here’s how Powers of Attorney integrate into a well-rounded estate plan:

1. Ensures Continuity in Financial Management**

Should you become incapacitated, a properly executed POA enables your chosen agent to seamlessly manage your finances. Without this document, your loved ones may face costly and time-consuming court proceedings to obtain guardianship or conservatorship.

2. Facilitates Medical Decision-Making**

A healthcare POA empowers your agent to make medical decisions consistent with your preferences. When combined with an advance healthcare directive or living will, it provides clarity to both medical providers and family members.

3. Prevents Court Intervention**

Without a POA in place, families often find themselves in court seeking authority to act on behalf of an incapacitated loved one. This can lead to delays, additional legal expenses, and potential disputes—all of which can be avoided with proactive planning.

4. Provides Clarity and Peace of Mind**

POAs reduce uncertainty by clearly designating who is authorized to act on your behalf. This clarity can be especially helpful in blended families, business ownership situations, or when managing complex assets.
